The AHA today voiced support () for the 340B Rebate Model Delay Act (H.R. 10770)in a letter to the bill’s House sponsors. The bipartisan bill would pause the Department of Health and Human Services’ 340B Rebate Model Pilot Program, currently set to go into effect Jan. 1, 2027.

The legislation would require drugmakers to provide 340B discounts up front at the time of purchase from Jan. 1, 2027, through Dec. 31, 2028, and prohibit use of federal funds to implement the rebate pilot or a substantially similar program during that two-year period. The legislation was introduced by Reps. Rob Bresnahan, R-Pa., Debbie Dingell, D-Mich., Tracey Mann, R-Kan., and Lois Frankel, D-Fla.

The bill follows the Oct. 9 lawsuit filed by the AHA, Maine Hospital Association and four safety-net hospitals in the U.S. District Court for the District of Maine. The lawsuit argues that HHS’ actions would expand the use of a proposed rebate model previously halted by the courts.
